Hon’ble Supreme Court Clarifies Legal Position on Refund
of Statutory Pre-Deposit
The Hon’ble Supreme Court of India, in State of Jharkhand &
Others v. M/s. BLA Infrastructure Private Limited, condoned the
delay, granted leave, and disposed of the appeal on 9 January
2026. The Court held that the refund due to the respondent on
account of the statutory pre-deposit made for maintaining the
appeal was governed by Sections 107(6) and 115 of the Jharkhand
Goods and Services Tax Act, 2017, and not by Section 54. It
agreed with the State’s submission that the Jharkhand High Court
had unnecessarily interpreted Section 54 while granting relief.
Accordingly, the Supreme Court clarified the legal position, set
aside that part of the High Court’s interpretation, and directed
that the refundable amount be released to M/s. BLA
Infrastructure Private Limited along with applicable interest,
strictly in accordance with law, within four weeks. All pending
applications were also disposed of.
